ACCEPTABLE USE POLICY

This Acceptable Use Policy (“AUP”) governs use of burble Inc.’s, and its affiliates (collectively, “burble”), websites (e.g., myburble.com), online services and applications, and any related downloadable software made available by burble for use therewith (collectively, the “Offerings”). “You” and “Your” mean the “Customer” individual or legal entity accessing and using the Offerings under an agreement with burble, and any users granted such access and use rights by Customer. Your use of the Offerings may be governed by other documents including, without limitation, burble’s Privacy Policy and End User License Agreement (“EULA”) as it pertains to the Mobile App.
- Prohibited Acts. You agree not to:
- interfere or attempt to interfere in any manner with the functionality or proper working of the Offerings;
- breach or otherwise bypass any security or authentication measures of the Offerings;
- transmit into or use with the Offerings any of the following: viruses, malware, malicious or destructive code, or any other routine, device, or other undisclosed feature (e.g., so-called time bomb, software lock, drop dead device, malicious logic, worm, Trojan horse, or trap, back door, or software routine) that either interferes with or otherwise harms or provides unauthorized access or causes unauthorized modifications to the Offerings;
- distribute content that interferes with or otherwise harms or provides unauthorized access or causes unauthorized modifications to the operation of any burble or related third-party networks, servers, or other infrastructure;
- use any robot, spider, data scraping or extraction tool, or similar mechanism in the Offerings;
- engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Offerings;
- reverse engineer, decompile, disassemble, attempt to gain unauthorized access to, or attempt to discover the underlying source code or structure of, the Offerings, burble work product, or the technology and software used to provide them, and all intellectual property and proprietary rights therein;
- access, use, or otherwise exploit the Offerings for purposes of competing with or disparaging burble or the Offerings, including but not limited to benchmarking, monitoring availability, performance, or functionality, or conducting competitive analysis;
- commercially sell, resell, license, sublicense, distribute, or frame the Offerings to a third party unless authorized by burble in writing;
- access, use, or test portions of the Offerings that burble has not authorized You to access, use, or test;
- override any security feature or bypass or circumvent any access or security controls or use limits of the Offerings (including without limitation, caps on keyword searches or profile views);
- remove any copyright, trademark, patent or other proprietary notices from the Offerings or any content on the Offerings;
- access or use the Offerings if You have been previously removed from any Offering by burble;
- upload, post, e-mail, text, transmit or otherwise make available (collectively, “Make Available”) any content that in our opinion constitutes or contains "affiliate marketing," "link referral codes," "junk mail," "spam," "chain letters," "pyramid schemes," or unsolicited commercial advertisement, except to the extent such content is provided to You by burble or one of its affiliates for a purpose specifically authorized by burble in writing;
- Make Available any content that is unlawful, harassing, defamatory, abusive, hateful, threatening, obscene, harmful, tortious, libelous, invasive of another’s privacy, vulgar, obscene, or racially, ethnically or otherwise objectionable including, without limitation, any sexually explicit content;
- Make Available any content that violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability;
- Make Available any content that promotes illegal or harmful activities or in any way that otherwise violates any applicable local, state, national, foreign or international law or regulation, intentionally or unintentionally;
- Make Available any content that you do not have a right to Make Available under any law or under any contractual relationship;
- Make Available any content that infringes or violates any party's rights, including, without limitation, using third-party copyrighted materials or the names or likenesses of others without appropriate permission and attribution, using third-party trademarks without appropriate permission or attribution or in a way that is likely or intended to cause confusion, or using or distributing third-party information (whether or not protected as a trade secret) in violation of a duty of confidentiality; or
- Make available any content that we otherwise determine to be inappropriate for the Offerings or inconsistent with burble image and reputation.
- Use Restrictions. You agree that You will not use the Offerings to:
- act or encourage activities in violation of any applicable laws, rules, or regulations (including those related to unlawful gambling or piracy) or otherwise in violation of any governing agreement with burble including, without limitation, any end-user license agreement or service agreement;
- use, store, share, host, copy, distribute, display, publish, transmit, or send content or promote, support, or facilitate a cause or action that is or could be deemed offensive, inflammatory, hateful, defamatory, discriminatory, obscene, abusive, invasive of privacy, or harmful to others;
- distribute unwanted, unsolicited, or harassing mass email, conduct phishing scams, or transmit unwanted promotional or commercial content, including spam;
- access (including through any interfaces provided within the Offerings) any burble product or service, or other third-party service or website, in a manner that violates the terms for use of, or access to, such product, service, or website;
- infringe or misappropriate any burble or related third-party copyright, trademark, or other intellectual property, proprietary right, license right, or legal content protection;
- mislead or confuse others by alleging to be someone else or alleging to represent an organization You do not represent; or
- violate the rights (including privacy or publicity) of others, or distribute personal or confidential information without securing the necessary rights, permissions, and consents.
- Children. By using the Offerings, You represent and warrant that You are at least eighteen (18) years old. The Children’s Online Privacy Protection Act of 1998 (COPPA) and other laws protect the privacy of minors. burble abides by applicable laws and guidelines regarding youth privacy. The Offerings are not intended for use by individuals under the age of eighteen (18) years old.
- Copyright Infringement/DMCA Notice. If You believe that any aspect of the Offerings violate Your or a third party’s copyright, please provide written notice (“DMCA Notice”) to burble as set forth herein or otherwise provided by the Digital Millennium Copyright Act (“DMCA”), as it may be amended from time to time. The DMCA Notice must include (a) the signature of a person authorized to act on behalf of the owner of the copyright interest (“Copyright Owner”); (b) a description of the copyrighted work that is believed to have been infringed upon; (c) a description of precisely where the alleged infringing work is located on Mobile App; (d) the Copyright Owner’s mailing address, telephone number and email address; (e) a statement by the Copyright Owner that they have a good-faith belief that the disputed use is not authorized by the Copyright Owner, its agent, or the law, or is not otherwise being conducted by another authorized owner or licensee of the work; and (f) a statement by the Copyright Owner, made under penalty of perjury, that the information set forth in the submitted written notice is accurate and that they are the Copyright Owner or are authorized to act on the Copyright Owner's behalf. The DMCA Notice should be immediately delivered to burble at the address set forth below and directed to the attention of the “Copyright Agent.” You acknowledge and agree that Your failure to properly comply with the requirements of the law and/or this provision may make Your DMCA Notice invalid.
- Violation of this AUP. In addition to any other remedies that may be available, burble reserves the right, in its sole discretion, to take any remedial action it deems necessary, including, without limitation, immediately suspending or terminating Your account or access and/or use of the Offerings to protect the rights and safety of individuals, customers, or burble, or if You otherwise use the Offerings in contravention to this AUP.
- Updates/Changes to this EULA. burble reserves the right to modify this EULA at any time and for any reason. burble will post the most current version of this EULA at Myburble.com/terms. You are responsible for periodically reviewing the referenced link to keep yourself apprised of any updates and/or changes to same. Your continued use of the Offerings after burble publishes notice of changes to this AUP indicates Your consent and agreement to the updated terms.
